Defect Description:

LANE DEPARTURE: WARNING

Potential Consequences:

1) when car is braking (whether it’s with foot on brake or using regenerative braking) and it goes over uneven road (example: manhole cover, pothole, uneven bricks, or anything that is not smooth pavement), the car stops braking and lurches forward. Driver has to push very hard on brake pedal to resume braking and sometimes requires fighting against the car to get it to stop. In addition to that, there are frequent warnings that various ADAS systems are not working. They go on and off and are unrelated to weather conditions and whether the car is dirty or not.

Defect Description:

STRUCTURE:BODY

Potential Consequences:

Explanation of Safety Risk: The inability to lock the doors of the Fisker Ocean while in the vehicle and in parked mode presents a significant safety risk. This defect can compromise the safety and security of the occupants in the following scenarios: 1.Immediate Threat from Robbers or Attackers: •If the vehicle cannot be locked from the inside while parked, occupants are vulnerable to external threats. In the event of an attempted robbery or physical attack, the inability to quickly secure the vehicle leaves the occupants defenseless. Locking the doors from inside the vehicle is a critical safety measure that can prevent assailants from gaining immediate access. 2.Emergency Situations: •During emergencies, such as a carjacking attempt or hostile confrontation, being able to lock the doors instantly is crucial for protection. The inability to do so can escalate the risk of harm to the occupants, as they cannot use the vehicle as a safe haven to delay or deter the attacker. 3.Psychological Impact: •Knowing that the vehicle cannot be locked from the inside can cause significant stress and anxiety for drivers and passengers, especially when traveling through high-risk areas. This mental burden can affect the driver’s ability to focus and respond appropriately to other driving conditions, further increasing the risk of accidents. 4.Standard Safety Protocols: •Many modern vehicles are equipped with the ability to lock doors from the inside as a standard safety feature. The absence of this functionality in the Fisker Ocean puts it at a disadvantage compared to other vehicles, making it less safe for its users. In summary, the inability to lock the doors of the Fisker Ocean while in the vehicle and in parked mode is a severe safety hazard. It leaves occupants vulnerable to external threats, increases the risk of harm in emergency situations, and induces psychological stress, all of which compromise the overall safety and security of the vehicle.

SERVICE BRAKES

Potential Consequences:

The vehicle is currently running the 1st half of 2.0. When pressing the brake or having the regen braking kick in to work towards a stop, if going over a bumpy surface, the braking will disengage and the car will lunge forward. This behavior has led to several near accidents where you are trying to come to a stop but the car lurges forward for a second. This requires you to have additional stopping distance to account for the potential the car will lose braking for a moment. This was communicated to be fixed by Fisker thanks to several compaints to the agency. However, this was clearly not fixed.

Potential Consequences:

My vehicle has been stuck at the 1st half of SW version 2.0 and has never been able to complete the full version of 2.0 upgrade. A ticket has been open with Fisker for this issue several months now with minimal communication. A tech advised that there was a component not taking the update correctly so the rest of the install was backing out. The problem now is that I am no longer getting SW updates so can't get these safety recalls addressed - NHTSA Campaign Number: 24V405000 and 24V404000. As of the past couple of months, Fisker has been totally non-responsive since there are no more local techs, no response to 800 number, or email. Essentially I am at a loss as to how to get these recalls addressed. I am raising this concern with the NHTSA as issuing recalls are great, but if the fix is within a software release and several cars can not get routine software updates the procedure to address recalls is broken and Fisker should be held responsible even if dispatching techs is required.

Corrective Action:

My vehicle has been stuck at the 1st half of SW version 2.0 and has never been able to complete the full version of 2.0 upgrade. A ticket has been open with Fisker for this issue several months now with minimal communication. STRUCTURE:BODY

Potential Consequences:

On June 12, 2024 I first noticed the door handle on the Front RH passenger door stayed extended when the vehicle was locked at the end of a short trip in town. When locked, the door handles on the Fisker Ocean are designed to retract flush with the surface of the door. The extended door handle was locked, so the car door could not be opened (as expected). The next morning, I unlocked the car using my key fob, causing the other door handles to extend. I then locked the car with the key fob, and all of the door handles retracted, except for the handle front RH passenger door. Once again, I unlocked the car, leaned over from the driver's side, and found that pulling on the interior door handle would not open the unlocked front passenger door. Keeping the car in Park, I exited through the driver's side door, walked around to the front passenger door, pulled on the extended handle to attempt to open that door -- after pulling on the extended handle, the door opened after two attempts. Closing that front RH passenger door once more, I returned to the driver's seat, leaned over and found that I was able to then open the front RH passenger side door by pulling the interior door handle to open that door. Testing further, I determined that the interior door handle would not open that door anytime the car was unlocked immediately after driving, or after being put into park (which unlocks the doors and extends the door handles on the Fisker Ocean. I have notified Fisker support and am waiting for a response to get this door handle / door latch mechanism inspected and repaired. I can provide video clips showing the conditions outlined above. Note: This 2023 Fisker Ocean One was manufactured in 8/2023 and I took possession of this vehicle on 12/15/2023. The installed software version on the car is Ocean OS 2.0

Potential Consequences:

When coming to a stop, the brakes “slip” causing the braking distance to increase. This significantly increases the potential of a crash. Secondly, the car puts itself in PARK and engages parking brake when at a stop sign or traffic light. This significantly increases the potential of a crash. Thirdly, the display panel notes a brake system and ADAS malfunction while driving. Lastly, the driver’s side rear taillight of the vehicle doesn’t work and requires new part to fix it - which isn’t available. This significantly increases the risk of a crash.

SERVICE BRAKES

Potential Consequences:

Several potential dangerous situations have occurred with this car. 1. Brakes often fail on first attempt, only stops with pumping them. 2. Car randomly swerved to right twice, each time stopping by hitting something. 3. Car has locked itself and am unable to unlock with key fob, had to manually force it open. 4. Accelerator pedal has weird clicking to it. 5. Strange cracking sound from solar roof. It is impossible to get any type of service for this car as Fisker is unresponsive to phone calls or email attempts. The tech in the Delaware region has been terminated and since the car is undeliverable it is impossible to get to the closest one which seems to be Atlanta. No way of knowing if they will ever service the car.
