An incorrect Occupant Classification System (OCS) Electronic Control Unit (ECU) may have been installed in the front passenger seat. (Nissan) is recalling certain model year 2016-2017 Nissan Maxima, 2013-2016 Nissan Altima, NV200, LEAF, Sentra, and Pathfinder, 2014-2016 Nissan NV200 Taxi, Infiniti QX60, QX60 Hybrid, and Q50 Hybrid, 2014-2017 Nissan Rogue and Infiniti Q50, 2015-2016 Nissan Murano, Murano Hybrid, and Chevrolet City Express, 2014-2015 Nissan Pathfinder Hybrid, and 2013 Infiniti JX35 vehicles. In these vehicles, the front seat passenger Occupant Classification System (OCS) may incorrectly classify an adult passenger as a child or classify the seat as empty despite it being occupied. As a result, the passenger frontal air bag may be turned off and not deploy in the event of a crash.

Potential Consequences:
On August 12 2023 on a trip to hershey PA my rogue felt like she was barely stuttering. I was passenger at the time, asked the driver if they felt that and if it was the car or the road because it felt almost like vibrations on uneven road. Then the rpm's dropped at highway speed like it needed to downshift, paused just above 2k and popped back up. Minutes later the transmission light came on. It continued to happen on and off on the way home and to the airport the following day. I parked her for a week until could get her to the garage (she moved less than 20 miles in that week). Taking her to winchester, the stutter became more "vibrant" and distinct happening no less than 12 times in 35 miles. I've never had issues previous to Aug 12. The shop said transmission failure. When I brought up the history of cvt issues and asked for additional warranty on the repair (beyond the 12 mos they quoted) . Obviously this is a known issue, the dealer makinge feel as if they are trying to ignore it is frustrating.

During highway driving speeds vehicle will suddenly lose power and slow down. Pressing accelerator pedal increases RPM but not the speed. With cruise control engaged vehicle will suddenly and abruptly slow down with RPMs climbing to 4000. I fear that I will be hit from behind because of suddenly slowing down. Also unable to pass vehicles due to loss of power.

Driving on Highway 65-68 MPH, RPMs rose drastically (4-5 RPMS) and gas pedal did not operate. Slowed to side of road, shut car off. Waited on side of road approximately 3-4 minutes restarted car and drove to home. Immediately made appointment at Bradenton Nissan on February 11, 2022 stating to the Service Dept. what had happened. They claimed "Transmission did not duplicate problem no problem=no found; no code related to CVT". On August 1, 2023 same thing happened on highway travelling approx. 67 MPH, went to change lanes and car would not operate; RPMs flew to 5-6. Pulled to traffic light stopped engine and started again; drove home. August 2, 2023 took to Bradenton Nissan where they stated it was a transmission problem. Why was this not fixed in February of 2022? It was a major safety issue at that time.

The contact owns a 2016 Nissan Rogue. The contact stated while driving 40 MPH and depressing the accelerator pedal, the vehicle failed to accelerate and started to jerk and hesitate. The contact stated that the RPM raised quickly, and the speedometer failed to operate as needed. The contact stated that the check engine warning light was illuminated. The contact parked at a nearby gas station for an hour before continuing to drive to her destination however, the failure persisted. The contact took the vehicle to an independent mechanic and the vehicle was diagnosed with needing the transmission to be replaced. The mechanic provided an oil change on the vehicle. The vehicle was not repaired and continued to experience the failure. The contact had another independent mechanic to inspect the vehicle at the residence and was informed that the transmission needed to be replaced. The vehicle was not repaired. The contact called the local dealer and made them aware of the failure. The manufacturer had been informed of the failure. The failure mileage was approximately 131,000.

On July 14th of this year, I was driving my vehicle on the highway when it abruptly accelerated without me changing my pressure on the gas pedal. The check engine light then turned on, which prompted me to have my car inspected as soon as I could. I did not have an appointment until July 20th and was unable to use my vehicle until then. On inspection, I was informed it was due to an issue with the transmission, but was also told this was a known issue with the 2016 Nissan Rogues. There was a class action lawsuit filed with these vehicles regarding their transmission as they exhibit a delay that’s typically accompanied by the engine revving while the driver depresses the gas pedal with “little to no increase in speed". According to the suit, other Nissan Rogue drivers have also experienced and reported stalling, jerking, lurching, juddering, hesitation and/or shaking while driving their vehicles, as well as premature transmission failure. The apparent CVT defect has been documented to occur without warning while a vehicle is being operated normally. This puts other drivers, as well as myself, in danger as this becomes an unreasonable safety hazard. I am aware that Nissan had accepted responsibility to repair these vehicles for this problem because of the inherent problems and widespread failure. It is also my understanding that the window to get these repairs ended on December 9th, 2022, and I purchased the vehicle 1 week later, unknowing and unwitting of these issues. I feel that Nissan is still responsible to fix their defective vehicle and I am asking that this repair be completed under the same terms as what was offered during their repair campaign. They are still responsible to make this right for the safety of the users of their product, as well as other drivers around them.

Potential Consequences:
The contact owns a 2016 Nissan Rogue. The contact stated while driving 40 MPH and depressing the brake pedal, the front driver’s side seat moved forward independently. The contact attempted to adjust the seat however, the seat failed to remain in place. The vehicle was taken to the dealer and the contact was informed that the weld of the seat had fractured and needed to be re-welded. The vehicle was not repaired. The manufacturer was contacted and stated that the vehicle was not under recall. The failure mileage was 92,000.
Corrective Action:
The contact owns a 2016 Nissan Rogue. The contact stated while driving 40 MPH and depressing the brake pedal, the front driver’s side seat moved forward independently.
